These Terms and Conditions ("Terms") govern your use of the services provided by Martejo Enterprise Inc., d/b/a Martejo Discount ("Martejo," "we," "us," or "our") through app.martejo.com, including online auctions, retail purchases, flooring sales, and warehouse checkout. By creating an account or using any of our services, you agree to be bound by these Terms.

General Terms
  1. All sales conducted by Martejo Discount are final. No returns or refunds unless explicitly stated by store management.
  2. Martejo Discount reserves the right to refuse service, cancel transactions, or remove listings at its sole discretion.
  3. All items are sold as-is, where-is. Descriptions are provided for reference and may not cover every detail or defect.
  4. Customers must be 18 years of age or older to create an account and participate in auctions or purchases.
  5. By creating an account, you agree to provide accurate and complete information and to keep your account credentials secure.
Auction Rules
  1. All bids are binding. Placing a bid constitutes a legal commitment to purchase the item at that price if you are the winning bidder.
  2. Payment is required immediately upon winning an auction. Winning bidders will be directed to complete checkout via our secure payment system. Failure to complete payment within the designated deadline (default: 24 hours) will result in automatic forfeiture of the item. No exceptions.
  3. Winning bidders must arrange pickup within 14 calendar days of the auction close date. Items not picked up within this window will be forfeited and no refund will be issued.
  4. The total amount due at checkout includes: (1) the winning bid amount, (2) a non-refundable buyer's premium (currently 11%), and (3) applicable sales tax (currently 8%). These fees are calculated automatically and displayed before payment.
  5. Shill bidding, bid manipulation, or any form of auction fraud is strictly prohibited and will result in immediate account termination.
  6. Martejo Discount reserves the right to cancel any auction at any time for any reason.
Payment Terms
  1. Accepted payment methods include credit/debit cards processed through our secure payment system (Stripe).
  2. All prices are in US Dollars (USD).
  3. A non-refundable buyer's premium is applied to all auction purchases. The current rate is displayed on each listing.
  4. Sales tax is applied as required by applicable Illinois state and local tax laws.
  5. Chargebacks or payment disputes initiated without first contacting Martejo Discount may result in permanent account suspension.
  6. Failure to pay within the payment deadline will result in automatic forfeiture of the won item and may result in account suspension or permanent ban for repeat offenses.
Pickup & Forfeiture Policy
  1. All items are pickup only at the designated Martejo Discount warehouse location unless shipping is explicitly specified on the listing. Do not assume shipping is available.
  2. Customers must schedule a pickup appointment through their account after payment is confirmed.
  3. A valid photo ID matching the account holder may be required at pickup.
  4. Items must be picked up during scheduled appointment times within 14 calendar days of the auction close date. Items not picked up within this window will be considered forfeited. No refund or credit will be issued for forfeited items.
  5. Martejo Discount is not responsible for items after they leave the warehouse premises.
Account Terms
  1. Martejo Discount reserves the right to suspend or terminate any account at any time for violations of these terms, fraud, or disruptive behavior.
  2. Account holders are responsible for all activity under their account.
  3. Repeated failure to pay for won auctions or pick up purchased items will result in account suspension or permanent ban.
  4. Approved exceptions to these terms may be granted at the sole discretion of store ownership and will be documented in the account record.

Limitation of Liability

To the maximum extent permitted by law, Martejo Enterprise Inc., d/b/a Martejo Discount shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Kane County, Illinois.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated version number and effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
